Regulations on the winner’s trademark use

Trademark of the National Contest BRAND of the year is registered in Trade Marks Expertise Department of the National Intellectual Property Centre of the Republic of Belarus, and is a protected trademark. The decision on the trademark registration dated 03.02.2003.

Distinguishing marks of BRAND OF THE YEAR National Contest winner are:

  1. Images of the Golden, Silver and Bronze medals of BRAND OF THE YEAR National Contest;
  2. The logotype of BRAND OF THE YEAR National Contest;
  3. Verbal indication of the finalist and winner status of BRAND OF THE YEAR National Contest aligned with the nomination and commodity group indications, which is mandatory. Verbal indication conforms to the one marked in the finalist»s and winner»s diploma.
1. The right to use distinguishing marks of BRAND OF THE YEAR National Contest winner:

1.1. The right to use images of statuses assigned to the medalists — winners of the Professional nominations and holders of the statuses specially instituted by the Steering Committee.
1.2. The right to use the logotype of BRAND OF THE YEAR National Contest is assigned to winners of the consumer nominations — ranked leaders by the popularity and preference degree in commodity groups, which participated in the Contest in accordance with the Steering Committee»s decision and were recognized in their status of winners by the International Jury»s decision.
1.3. The right to use verbal indication of the finalist and winner status of BRAND OF THE YEAR National Contest is assigned to the finalists and winners of the Professional and Consumer nominations.

2. The regulations to use the Golden, Silver and Bronze medals of BRAND OF THE YEAR National Contest winner

2.1. The medalist can place the medal»s image on all the goods of the assortment line, manufactured under the mark of the brand winner, as well as on advertisement mediums:

  • Packages and labels;
  • Polygraph materials (placards, posters, booklets, leaflets etc)
  • Electronic carriers;
  • Sites and banners in the Internet;
  • Video commercials;
  • Other samples

2.2. The winner»s medal image can be used either separately or together with the verbal indication of the winner»s status in accordance with the diploma with mandatory indication of the year in both cases. For example:

2.3. The Steering Committee provides the companies with an electronic variant of the medal image in two variants (one for placing on the web-site and one to use in polygraphy)

3. The regulations to use the logotype of BRAND OF THE YEAR National Contest

3.1. The participants — holders of the winner»s status in Consumer nomination can use the logotype of BRAND OF THE YEAR National Contest. The logotype can be used on all the goods of the assortment line, manufactured under the mark of the brand winner, as well as on advertisement mediums:

  • Packages and labels;
  • Polygraph materials (placards, posters, booklets, leaflets etc)
  • Electronic carriers;
  • Sites and banners in the Internet;
  • Video commercials;
  • Other samples

3.2. The logotype can be used either separately or together with the verbal indication of the winner»s status in accordance with the diploma with mandatory indication of the year in both cases. For example:

3.3. The Steering Committee provides the companies with an electronic variant of the logotype.

4. The regulations to use the verbal indication of BRAND OF THE YEAR National Contest winner»s and finalist»s status

4.1. The verbal indication of BRAND OF THE YEAR National Contest winner»s and finalist»s status can be used by the Contest participants — winners of the Professional and Consumer Nominations as well as by the holders of the special statuses instituted by the Steering Committee, and by the finalists of the Consumer Nominations. The diploma issued in accordance with the decision of the International Jury serves to confirm the status. The verbal indication can be used:

  • Aligned together with medal image and logotype image — by the winners of the Professional and Consumer Nominations
  • Separately, without medal of logotype images
  • In advertisement and PR texts, interview etc;
  • To be declared orally at any arrangement, presentations, development etc;
  • In other cases
5. Rights and obligations of the Steering Committee of the National Contest BRAND OF THE YEAR

5.1. The Steering Committee of the National Contest BRAND OF THE YEAR has to verify the observance of the given regulations by the winners and finalists as well as to correct inaccurate use bringing prejudice to the image of the Contest, Contest winners and participants. The Steering Committee can warn on the violation of Regulations on the Contest»s marks use.

5.2. The Steering Committee of the National Contest BRAND OF THE YEAR has to verify the observance of the regulations on the Contest»s marks use. In case marks or statuses were misappropriated, the Steering Committee must warn the user — infringer on the regulations violation. In case of repeated violation the Steering Committee has the right to appeal it ad litem.

5.3. The Steering Committee has to promote the Contest development and contribute to popularization of the Contest and its marks

6. Rights and obligations of the National Contest BRAND OF THE YEAR winners and finalists related to the Contest marks

6.1. The winners and finalists have to verify the observance of the given regulations and correct the inaccurate use bringing prejudice to the image of the Contest, other Contest winners and participants. Winners, finalists and participants can notify the Steering Committee on the noticed violations of the regulations and rights to use the Contest marks.

6.2. The winners and finalists promote the Contest development and contribute to popularization of the Contest and its marks
